1. Agreement

These terms govern your use of departure1903.com and any purchase from Departure 1903. The shop is operated by Departure 1903 ("Departure 1903," "we," "us"). By using the site or placing an order, you agree to these terms, the Privacy notice, and the Shipping and Returns policies.

If you do not agree, do not use the site.

2. The shop

We sell apparel and accessories. Items are print-on-demand. Descriptions, photographs, and stories are for information. Colors vary by screen and by print run. We may correct errors, refuse or cancel orders, and limit quantities.

We do not guarantee uninterrupted access to the site.

3. Orders and payment

An order is an offer to buy. We accept it when we send an order confirmation and send the job to production, subject to stock of blanks, print capacity, and our right to cancel for error, fraud, or impossibility.

Prices are in USD unless stated otherwise. You are responsible for applicable taxes. Payment is due at checkout through our payment processor.

Because items are made after you order, cancellation after production has started is limited. See Returns.

4. Intellectual property

The stacked wordmark — DEPARTURE over 1903, navy, wide tracking, A without a crossbar — is the house mark of Departure 1903. Site design, original type layouts, and original product copy (except where we quote the public historical record) are ours or licensed to us. You may not copy, scrape, or sell them without written permission.

Historical facts, names, dates, and numbers are not a claim to other people's trademarks, photographs, patents, or official marks. We do not claim the National Park Service, the Smithsonian, the National Museum of the U.S. Air Force, the U.S. Navy, the U.S. Air Force, the U.S. Marine Corps, the Department of Defense, NASA, Boeing, Lockheed, or any squadron, ship, or manufacturer. We do not lock up Wright Brothers as a logo or brand line. Personal names in stories are historical.

You may not use our wordmark, or any confusingly similar lockup, on goods or in a shop name.

5. No endorsement

Departure 1903 is a private merchant. Nothing on this site is an official product of, or endorsed by, the National Park Service, the Smithsonian Institution, the National Museum of the U.S. Air Force, the Department of Defense, or any service branch. Historical citation is not a partnership.

6. Prohibited uses

You may not:

• Use the site for any unlawful purpose

• Interfere with the site, other users, or our processors

• Attempt unauthorized access to accounts, checkout, or admin

• Scrape the catalog or copy product stories at scale

• Resell our goods as official government, museum, or service merchandise

• Use the wordmark or product art to imply military, museum, or family-foundation endorsement

• Upload malware or automated abuse

We may refuse service or cancel orders if we reasonably believe these rules are broken.

7. User accounts and content

If you create an account, you are responsible for the password and for activity under it. Comments, reviews, or messages you send must be lawful and must not infringe others. We may remove content and close accounts.

8. Disclaimer of warranties

THE SITE AND THE GOODS ARE PROVIDED AS AVAILABLE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT DESCRIPTIONS ARE ERROR-FREE OR THAT PRINT COLOR WILL MATCH YOUR DISPLAY.

Some places do not allow implied-warranty disclaimers. In those places, the disclaimer applies only as far as the law allows. Nothing here limits rights you have as a consumer that cannot be waived.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DEPARTURE 1903, Departure 1903, AND THEIR PEOPLE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR SUBSTITUTE GOODS, ARISING FROM THE SITE OR FROM AN ORDER.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER. OUR TOTAL LIABILITY FOR ANY OTHER CLAIM RELATED TO THE SITE WILL NOT EXCEED the amount you paid us in the twelve months before the claim.

These limits do not apply to liability that the law of Florida does not allow us to limit, including (where applicable) liability for death or personal injury caused by negligence, or for fraud.

10. Indemnity

You will indemnify and hold harmless Departure 1903 and Departure 1903 from claims, damages, and reasonable legal fees arising from your misuse of the site, your violation of these terms, or your infringement of someone else's rights, except to the extent caused by our willful misconduct.

11. Governing law and disputes

These terms are governed by the laws of Florida, United States, without regard to conflict-of-law rules. [VENUE: state and federal courts in Duval County, Florida / arbitration clause to be added by counsel.] You and we consent to that forum, except that either of us may seek injunctive relief for intellectual-property or unauthorized-access claims in any court of competent jurisdiction.

12. Changes

We may change these terms by posting an updated version on the site. The date of the published version controls. Continued use after a change is acceptance of the new terms. Material changes to orders already accepted will not apply retroactively except as the law requires.
